Jefferson Writes Letter About the Judiciary, 31OCT2020

On this day in 1823, Thomas Jefferson writes a letter about the judiciary.
 
"At the establishment of our constitutions, the judiciary bodies were supposed to be the most helpless and harmless members of the government," he wrote. "Experience, however, soon showed in what way they were to become the most dangerous."
 
What did he think was at fault?
 
"[T]he insufficiency of the means provided for their removal," Jefferson concluded, "gave them a freehold and irresponsibility in office; that their decisions, seeming to concern individual suitors only, pass silent and unheeded by the public at large; that these decisions, nevertheless, become law by precedent, sapping, by little and little, the foundations of the constitution, and working its change by construction, before any one has perceived that that invisible and helpless worm has been busily employed in consuming its substance."

The courts have long and often stepped out of bounds as to their constitutional authority and duties.  They have been legislating from the bench and that includes the supreme court as well.  I think a supreme court judge should have a longer term, especially to temper new governments after they were installed but it shouldn't be a life term.  I think a term of 16 years would be good for them.  I believe this is similar to what Thomas Jefferson meant in this quote.

He meant that justices should be ruling by law and not lawing by rule.

 

its come to the point where scotus rules on parties lines and the liberals don’t like that the lines were just moved constitutionally so they want to change the rules. It’s like talking with kids about fairness... there is no fairness... I make the rules and if you don’t like them then you can move out when you’re all grown up.

Goodbye America, it was good while it lasted, The people ready to once again tuck tail to the power of corruption and complacency.  The office of the Presidency has once again surrendered it's authority to the judicial branch.  Has anyone read any of our founding documents? Or our founders writings? But hey, we might survive another 8 years of communist take over from within. So will President Kamala sell us to china or iran, or just rent out her slaves to the highest bidder? Sad!

Ha, ha! If only, I think we'd see a lot of foreign blue helmet police . I say we should beat them at their own game. All workers should just quit, take a month or so off and rest up. No taxes, no food, electric, water, nothing. Let them burn loot and murder themselves into starvation. They are then out of our way and the clean up and reconstruction will create lots of good jobs.
